Mr. Yang Met with both Secretary-Generals of HCCH and PCA
 

On May 15, 2015, Mr. Duncan Matthews, Mr. Michael Collett and Ms. Sara Masters, three Queen’s Counsels from 20 Essex Street, a British well-known law firm, and Mr. Ing Loong Yang, a SHIAC’s Singapore arbitrator and foreign consultant of China Academy of Arbitration Law, visited SHIAC.

Mr. Yang Jianrong, the Chairman of SHIAC extended a warm welcome to Mr. Matthews’ delegation. Mr. Yang introduced SHIAC’s latest development, the innovations of FTZ Arbitration Rules, international aviation arbitration and the BRICS Dispute Resolution Center. Mr. Matthews expressed his appreciation to SHIAC’s rapid development and numerous innovations including FTZ Arbitration Rules and international aviation arbitration. The both parties exchanged respective opinions on future communication and cooperation.

Mr. Huang Wen, the Deputy Secretary-General of SHIAC and Mr. Yao Hongmin, the Director of Research Center of SHIAC, attended the event.

Seminar of Effect of Economic Sanctions on Arbitration

On May 15, 2015, 20 Essex Street Chamber, a well-known British law firm, and SHIAC jointly held a Seminar of “Effect of Economic Sanctions on Arbitration”. On behalf of SHIAC, Mr. Huang Wen, the Deputy Secretary-General, extended a warm welcome to the three Queen’s Counsels from 20 Essex Street and over 40 attendants including SHIAC’s arbitrators and mediators from China, Japan and Italy and local lawyers. Mr. Huang also expressed appreciation to Mr. Ing Loong Yang, a SHIAC’s Singapore arbitrator, for his proposal of discussing the legal issues related to the Effect of Economic Sanctions on Arbitration, and encouraged the attendants to discuss related theoretical and practical issues and cases. As an innovation, Mr. Ing Loong Yang, the proponent of the seminar, was invited to host the event.

On the seminar, Ms. Sara Masters introduced the legal regime and status quo of EU economic sanctions. Then, Mr. Michael Collett elaborated the legal countermeasures of EU economic sanctions in respect of contractual issues. Lastly, Mr. Duncan Matthews analyzed the duties and obligations of arbitral tribunal in the cases involving EU economic sanctions.

The attendants and speakers had thorough discussion on the topics of the legal basis and risk aversion of stop payment and refuse payment to corporations in sanctioned states, the legality, consequences and management of economic sanctions, the draft of contract clauses, risk management of business deals, and the judging patterns in the cases involving economic sanctions.

Mr. Zhang Yue, the Deputy Secretary-General of SHIAC, and Mr. Yao Hongmin, the Director of Research Center of SHIAC attended the event.
