SHIAC & L-Council jointly held the Moot Arbitration
 

The Moot Arbitration jointly held by SHIAC and China Legal Executive Council was held in Hearing Room 1 of SHIAC on September 19th, 2014. The legal councils from more than 20 famous companies which are all members of L-Council attended this event.

The mock tribunal was composed by SHIAC arbitrators. They are Mr. Chen Luming as the presiding arbitrator and Mr. Wu Jian, Mr. Huang Wen, also the Deputy Secretary-Genreal as co-arbitrators. Lawyers from King & Wood Mallesons Shanghai Office and Fangda Partners acted as the representatives of Claimant and Respondent. The mock hearing was designed to resolve an international sales of goods dispute. The issues therein included objection to jurisdiction, decision or jurisdiction by the tribunal, cross-examination of evidence, application of substantive law, parties’ statement, mediation and post hearing arrangement. The legal councils have acknowledged the arbitral proceedings through the designed hearing, and have learnt legal skills in arbitration.

After the moot arbitration, the legal councils raised questions about evidence, determination of working language, function of expert opinion, arbitration fees between Chinese and foreign arbitration institutions and choosing of the applicable law. Participants from SHIAC and lawyers gave answers to these questions from different perspectives. The talk was fruitful and in a warm atmosphere.

Mr. Wen Wanli, Vice Chairman & Secretary-General of SHIAC attended the meeting before the mock hearing, and made the welcome address. Ms. Wang Weijun, Deputy Secretary-General attended the event.
