The 3rd Emerging Legal Service Expo- LEGAL+ Summit Forum successfully held

 

On 16th November 2018, The 3rd Emerging Legal Service Expo – LEAGAL+ Summit Forum was held successfully in Shanghai. The summit was co-hosted by Shanghai Law Society, East China University of Political Science & Law(”ECUPL”), Shanghai Bestone Information Technology co., LTD, and Lvxin News, and co-organized by Shanghai International Arbitration Centre(”SHIAC”), Shanghai Bar Association, Shanghai Notary Public Association, Shanghai Judicial Think Tank Institution, Benchmark Chambers International, Shanghai Corporate Counsel Association, Shanghai Association for Social Application of Big Data and Shanghai Law Research Institution. It combined one main forum and seven sub-forums with different themes. Over one thousand attendees from governments of legal political and legal departments, corporate legal counselors, representatives from law & technology firms locally and globally, universities and colleges, investment institutions and media joined meeting.

 

Mr. Liu Qichang, Deputy Director of Information Centre in Ministry of Justice of PRC; Mr. Wang Xie, Deputy Director General of Shanghai Bureau of Justice,; Ms. Chen Jingying, Vice President of ECUPL; Mr. Shi Weidong, Vice President of Shanghai Law Society; Mr. Sheng Leiming, Vice President of China Lawyers Association presented the opening speech.

During the main session, the first research report in emerging legal service was published by China Emerging Legal Service Research Centre jointly established by Lvxin News and ECUPL. Meanwhile, the establishment of China Emerging Legal Service Industry Union was announced. The keynote speeches focused on artificial intelligence, block chain and other hot spots in legal service and were presented by Mr. Liu Jiang, vice president and executive director in politics & law department of IFLYTEK Co.,Ltd,; Mr. Brain Liu, the founder and investor of LegalZoom; Mr. Cai Liang, Deputy Director of BlockChain Professional Committee in China Computer Society and  Executive Deputy Director of BlockChain Research Center in Zhejiang University; Mr. Tan Jun, General Manager(”GM”) of legal affairs in Baidu; Mr. Ji Weidong, Senior Professor in Shanghai Jiaotong University, Changjiang Scholar in Ministry of Education of PRC.

 

The Forum set up a roundtable discussion on the theme of "New Technology, New Business Forms of Legal Service under New Model". Mr. Yu Weifeng, President of Shanghai Bar Association; Mr. Yang Qin, Vice President and Legal Counselor of Ctrip Group; Mr. Xue Jun, Vice Dean of Law School of Peking University; Mr. Feng Zihao, Founder and Chairman of Shanghai Bestone Information Technology co., LTD shared the opinions and experience. Mr. Yang Qin mentioned we are required to open cross-border mode, enrich our knowledge constantly and provide customized legal services in order to reduce the possibility of substitution under the new opportunities and challenges.

 

Seven different topics focused on the hot spots as “Scientific & Technological Development promotes the Accuracy and common benefit of Legal Service”; “Chain of Trust – Blockchain & Legal Service Innovation”; “Technology & Service Mode Innovation in Legal Profession”; “Enterprise Intelligent Risk Control & Dispute Resolution”; “Intellectual Property Right Protection in Digital Environment”; “Technical Application & Organizational Innovation in Dispute Resolution”; “Capital Theory with Science & Technology in Law” were discussed in the afternoon. They explained the content in data application with artificial intelligence legal robot, blockchain+storage application, compliance control for Internet service business, how to improve the efficiency of law firm alliances with technology, typical cases sharing of unfair competition and the innovation & development of the legal professions.

 

The sub-forum “Enterprise Intelligent Risk Control & Dispute Resolution” was hosted by SHIAC, Shanghai Law Society, ECUPL, Shanghai Bestone Information Technology co., LTD, Lvxin News, co-supported by Senior Legal Risk Management, Special Invitation Committee of Shanghai Bar AssociationWintell & CoDuan & Duan, Beijing Dentons Law Offices,LLP. The seminar chaired by Mr. Huang Ningning, managing partner of Grandall Law Firm. More than 150 guests from the enterprises, law firms and universities attended it.

 

Ms. Wang Fengmei, CEO of Lvxin News announced “2018 Legal Risk & Compliance Index for listed enterprises in Yangtze River Delta”. Mr. Shi ZhiweiVice President of Senior Legal Risk Management and the Research Group Leader for Legal Risk Index of Chinese listed companies explained it in details.

 

Mr. Shen Li, Chief Legal Officer, Noah (China) holding co., LTD made a keynote speech entitled “The Importance of Risk Control System in Private Equity Investment”. He explained the meaning of risk control combining with his own experience from five aspects as below: risk control in value concept, risk control in decision-making process, risk control in projects, risk control in post-investment management & risk event processing. He also mentioned to treat the risk control with a professional, independent and strict attitude. For the risk control in a single project, we should study in depth for investment industry and projects.

 

Mr. Lu Yuping, Legal Director of TOTO (China) co., LTD gave a keynote speech entitled “Intelligent risk control & Management Innovation”. He introduced the method for company to prevent risks and manage legal affairs through three aspects: source of the risks, risk transformation, method for precaution of risks.

 

Mr. Zhou Bo, Managing partner of WINTELL&CO made a keynote speech entitled “Innovative Application of Insurance using in Enterprise Legal Risk Precaution and Control”. He explained the risk categories faced by enterprises and  believed that insurance plays an important role in risk prevention for enterprises under new situation with sharing two cases: 8.12 Tianjin Binhai New Area Explosion Accident and Schneider Electric Fire Compensation. He also gave some hints on the relationship between the insurance value and amount, the principle of purchasing insurance etc.

 

Ms. Jin Li, Senior Partner in Beijing Dentons made a keynote speech entitled “Corporate Compliance & Construction of Risk Management System”. She made suggestions on risk management system from five aspect as below: Initial Information Framework Establishment, Risk Assessment, Risk Management Strategy Formulation, Implement for Solution and Monitoring Improvement.

 

Ms. Wang Weijun, Deputy Secretary General from SHIAC gave a keynote speech entitled “Integration&Innovation: Arbitration Dimension for Enterprise Dispute Resolution”. She suggested that companies may chose the appropriate dispute resolution system by comprehensively evaluate the time, cost and procedure quality among different ways. She also adviced that legal counsels may take part in formulating the arbitration clause and setting a complete pre-review mechanism, establish arbitration case management system and highly valued the experience in participating in commercial arbitration.

 

Afterwards, a roundtable discussion with the theme of “Chinese enterprise have the demand to establish compliance risk control system” was held. Chen Zhenfu, Partner of Taylor Wessing chaired sub round table “Corporate Governance & Risk Compliance”. Mr. Ye Xiaozhong, President of Senior Legal Risk Management and Co-director of Legal Affairs Research Centre in China University of Political Science & law enterprise; Mr. Ding Chaohui, Director of Legal Risk Control Department of CIFI Group; Ms. Zhu Xianglian, Senior consultant of AllBright Law Offices and  former Chief Compliance Officer of GE China joined the discussion. 

 

Mr. Ye Xiaozhong pointed that compliance is the bottom line of business management and core competitive component for the enterprise. But Chinese enterprises don’t carry out the compliance work in a systematic way and the relavant functions are dispersed in various departments. To the real problems encountered in building the compliance system for state-owned corporate, the document entitled “Central Corporate Compliance Management Guidelines” just published gives a clear direction. Mr. Ding Chaohui explained the transformation from internal control for legal affairs to compliance and risk control inside the corporate. The main responsibility for legal risk control department includes legal risk, compliance risk management, as well as the overall risk system management. Ms. Zhu Xianglian mentioned that state-owned enterprise whether the size is big, small or medium, all have to establish a compliance risk control system. Chinese enterprises need a healthy compliance risk control system.

 

Mr. Ju Xiaolin, Partner & Deputy Director of Duan&Duan chaired roundtable entitled “Building Multiple Dispute Resolution Mode for Enterprise Rights Protection”. Mr. Xu Xinlin, GM of legal deptartment of HQ APP-China, Mr. Wu Dong, deputy GM in TaiPing Fund Management Co.,Ltd., Mr. Jiang Wei, executive director east region for legal compliance department of PingAn Trust, Mr. Liu Hailong president of Inner Mongolia Enterprise Legal Counsel Association & vice president of SK.Xing joined the session.

 

Mr. Xu Xinling pointed disputes among the enterprises are mainly dealt through litigation and arbitration. With the development of science and technology, enterprises now can use the Internet platform for mediation, third-party evaluation agency and other channels to solve the disputes. Mr. Wu Dong mentioned the way to resolve disputes has always been a topic in the financial industry. No matter in the insurance, banking or trust industry, they all have their own understanding and preference in choosing dispute resolution approaches. More and more large capital management companies choose arbitration to resolve dispute as highly matching charactoristics  between arbitration’s advantages and the requirements for efficecy,  authority and professionalism in capital management industry, Mr. Jiang Wei mentioned the new assets management regulation issued recently, redefines the important framework policy for asset management products with the amount of nearly 100 trillion RMB. He shared his thoughts on multiple dispute resolution path for asset management products, especially for financial asset management products under the new condition. Mr. Liu Hailong mentioned the ability to establish a common psychological expectation is the key for the client to decide whether to choose the litigation or not. The Big data reports based on the overall case analysis and integration will help the client to establish expectation for solving disputes through ADR.

 

Ms. Xu Shanshan, director of Special Invitation Committee of Shanghai Bar Association and senior partner in HIWAYS Shanghai chaired the sub roundtable “Intelligent Management Innovation in Corporate Legal Affairs” Ms. Yuan Yunyu, GM of legal department of Shanghai Zhenhua Heavy Industries Co., Ltd. (ZPMC); Ms. Liu Yuan, product manager from LexisNexis; Mr. Shi Zhiwei, vice president of  Senior Legal Risk Management and leader of Legal Risk Index Research Group for China Listed Company; Mr. Shen Li, Chief Legal Officer, Noah (China) holding co., LTD joined the discussion.

 

Ms. Yuan Yunyu mentioned intelligent enterprise legal management is not doing well for many companies at the present. We can use the intelligent management in contract review and legal risk control system establishment for the holding companies. Mr. Shen Li mentioned the development for legal affairs in different companies can be roughly divided into survival stage, service stage, management stage and profitability stage, and the requirements for intelligent management of legal affairs are different at the different stage.

 

Ms. Liu Yuan shared how to use the professional service to improve the efficiency for risk prevention under the background of artificial intelligence and big data technology.

 

Mr. Shi Zhiwei started from SASAC research on informatization for Chinese enterprises. As mentioned above, it has not been popularized in the aspect of legal informatization for the companies in the research sample base. Therefore, Science & technological innovation, artificial intelligence in legal affairs management still needs to be developed.
