SIACA Launches the “Arbitration Aids Aviation" Project

Affected by the global spread of the Covid-19, the aviation industry chain has been severely affected, and a large number of aviation disputes need to be resolved urgently. In order to help aviation companies resume full-scale business as soon as possible, reduce the cost of dispute resolution for aviation companies, and effectively and fairly settle these disputes, Shanghai International Arbitration Center, under the guidance of the Department of Policies and Laws of Civil Aviation Administration of China and the China Air Transport Association, launched aviation dispute resolution "Green Passage" in this special moment, officially as the "Shanghai International Aviation Court of Arbitration 'Arbitration Aids Aviation 'project". The Shanghai International Aviation Court of Arbitration will constitute the "Shanghai International Aviation Court of Arbitration ‘Arbitration Aids Aviation’ Mediator Panel".


The Shanghai International Aviation Court of Arbitration, jointly established by the International Air Transport Association, the China Air Transport Association and the Shanghai International Arbitration Center, is the world's only professional aviation arbitration platform. It is responsible for the mediation and arbitration services under the SIACA Arbitration Aids Aviation Project, and the relevant mediation and arbitration procedures will be conducted in the aviation court. At the request of the parties, online mediation, online arbitration, and other convenient dispute resolution methods can also be provided.


From the date of this announcement to December 31, 2020, disputes between airlines, airlines and airports, airlines and aircraft leasing companies, airlines and sales agents, airlines and engine manufacturing enterprises, airlines and aviation fuel, aviation communication, aviation materials, aviation food and other enterprises can be submitted to the Shanghai International Aviation Court of Arbitration by written request. The mediation cases accepted under this project only charge a case registration fee of RMB 1,000, without any further mediation fees. The arbitration fees will be partially reduced for arbitration cases.

On August 28, 2014, the International Air Transport Association, the China Air Transport Association and the Shanghai International Arbitration Center officially signed the "International Aviation Arbitration Strategic Cooperation Agreement", and jointly established the Shanghai International Aviation Court of Arbitration. Twenty-three experts from International Air Transport Association, China Air Transport Association, world-renowned aviation companies, and domestic and international aviation law schools formed the Shanghai International Aviation Arbitration Experts Committee.

 

In December 2014, on the basis of aviation legal experts recommended by International Air Transport Association and China Air Transport Association, Shanghai International Arbitration Center recruited 71 additional arbitrators in the field of international aviation. The Shanghai International Arbitration Center's Panel of Arbitrators has 151 arbitrators with background in aviation law, including 89 arbitrators from Mainland China, accounting for 58.94%, 62 from Hong Kong SAR, Macau SAR, Taiwan Region and foreign countries, accounting for 41.06%.


During the past six years, the Shanghai International Aviation Court of Arbitration has been providing professional and efficient aviation dispute resolution services for the parties. The scope of its cases includes air transportation, aircraft manufacturing, aircraft sales, aircraft financial leasing, aviation insurance, fuel supply, general aviation custody, ground services and ticketing agencies and other various types of aviation disputes in the aviation industry. 

 

 

Through comprehensive and in-depth cooperation with the International Air Transport Association and the China Air Transport Association, the Shanghai International Aviation Court of Arbitration introduced international aviation arbitration into China, which has promoted the development of China's aviation arbitration and made Chinese aviation enterprises more actively participate in and use international arbitration to protect legitimate rights and interests and has laid foundation for enhancing Chinese aviation industry’s voice in the international market and constructing an international shipping center in Shanghai.


Since its establishment, the Shanghai International Aviation Court of Arbitration has been receiving attention and support from the aviation industry and social community. In 2017, with the support of the Changning District Government of Shanghai, the Shanghai International Aviation Court of Arbitration has its premises settled in the Shanghai Hongqiao Linkong Economic Park which has nearly 600 square meters of office facilities dedicated to aviation arbitration. The Linkong Economic Park focuses on the aviation service industry and brings together aviation companies such as aviation design, aircraft trade, aircraft operation services, supporting operation services, aircraft recycling and logistics, and aviation extension services. Relying on the location advantage of Hongqiao Business District adjacent to Shanghai Hongqiao International Airport and its great transportation convenience, the office of Shanghai International Aviation Court of Arbitration is set up to provide convenient legal services for enterprises in the air transportation industry, civil aviation and comprehensive service industry, and also provide a place for training, seminars and other series of events of aviation arbitration.


In December 2018, with the support of the Chengdu Shuangliu District Government of Sichuan Province and the Chengdu Shuangliu Pilot Free Trade Zone Administration, the Southwest Service Center of the Shanghai International Aviation Court of Arbitration was inaugurated in the Chengdu Shuangliu Pilot Free Trade Zone. Shuangliu, as an important segment of the Sichuan Tianfu New District and the Pilot Free Trade Zone, an integral part of Chengdu's central urban area and the location of the country's fourth-largest hub airport, is the field of national plan for the construction of the Chengdu Linkong Economic Demonstration Zone. The establishment of the Southwest Service Center of Shanghai International Aviation Court of Arbitration is a beneficial attempt for Shuangliu to develop its aviation economy and build a diversified dispute resolution mechanism. It has opened up new channels for mutual assistance in aviation arbitration services and arbitration system and promotion of rule of law, internationalized, and convenient business environment in Shuangliu.


 

As a professional aviation dispute resolution platform, the Shanghai International Aviation Court of Arbitration also pays great attention to academic research and the cultivation of professional talents, and has formed a certain social influence and cohesion. Since 2015, the Shanghai International Aviation Court of Arbitration has successfully held the "Shanghai International Aviation Arbitration Forum" as the organizer for five consecutive years, providing a professional venue and platform for global aviation law academic exchanges and discussions. 

 


"Aircraft Leasing Legal Seminar", "Aviation Security and Passenger Information Protection", "Mediation of Aviation Disputes" and many other seminars were held in Shanghai International Aviation Court of Arbitration. 


 

The Shanghai International Aviation Court of Arbitration has hosted the “Leiden-Sarin International Air Law Moot Court Competition” China Regional Round for two consecutive years to provide training and practice for foreign-related aviation law professionals. This international competition is the most influential international moot court competition in the field of international aviation law. It was initiated by the proposal of the International Civil Aviation Organization, and co-founded by International Research Center for Aviation Law and Space Law of Leiden University and the India Sarin Memorial Legal Aid Foundation. The Shanghai International Aviation Court of Arbitration is also the organizer of the 11th International Competition designated by the organizer. After Delhi, Dubai, Istanbul, Abu Dhabi, Bucharest, Beijing, Jakarta, Valletta and Seoul, Shanghai will welcome the gathering of the world's top international aviation law experts and the air and space law schools in the spring of 2021.
