Early Spring Buffet Reception Organized by SHIAC and ICC Shanghai was Successfully Held

On the night of 5 March 2021, Shanghai International Arbitration Center (hereinafter as “SHIAC”) and International Chamber of Commerce Shanghai Representative Office (hereinafter as “ICC Shanghai” ) jointly hosted an early spring buffet reception titled “Diversity: Soft Power of an International Arbitration Hub” at the venue of Shanghai International Dispute Resolution Center, which is located in Qiantan area of Pudong, Shanghai. This was also the first show of ICC Shanghai after its settlement in the Shanghai International Dispute Resolution Center.


    More than 70 guests participated the event, including leaders and representatives from World Expo Area Administrative Bureau of China (Shanghai) Pilot Free Trade Zone, Shanghai Arbitration Association, Shanghai Bar Association, Shanghai Arbitration Commission, East China University of Political Science and Law, Shanghai University of Political Science and Law, Fudan University, Hong Kong International Arbitration Center Shanghai Office, Singapore International Arbitration Center Shanghai Office, Korean Commercial Arbitration Board Shanghai Office, CAS Shanghai Alternative Hearing Centre and other well-known arbitration institutions which had opened its Shanghai representative offices, and representatives from Commercial Aircraft Corporation of China Ltd., China Eastern Airlines Group, Shanghai Automotive Industry Corporation, Junyao Group, Tesla Motors, Saint-Gobain and various enterprises and lawyers from renowned law firms from the Yangtze river delta area.

Ms. Huang Zhijin, legal expert for ICC Shanghai, served as the host of the event.

 

    At the beginning of the event, Mr. Ma Yi, Vice Chairman & Secretary-General of SHIAC delivered the welcome remarks. He mentioned that during the process of making Shanghai a globally-oriented international arbitration hub in the Asia-Pacific area, in addition to the improvements of hardware and software, the devotion of legal community including arbitration experts and all legal practitioners is of great significance, in order to fulfill the soft power of an international arbitration hub and to accomplish the most important mission of the generation of arbitration practitioners. He also thanked the administrative departments, fellow arbitration institutions, clients from enterprises, law firms and colleges and universities for their great support to the project of Shanghai International Dispute Resolution Center.


   Mr. Xu Xin, Head of World Expo Area Administrative Bureau of China (Shanghai) Pilot Free Trade Zone, also delivered welcome remarks to the event. He mentioned that, by entering into the 31th year of Pudong’s exploitation, Shanghai is moving forward in a more international and diversified way. The improvement of business development cannot be parted from the devotion of legal practitioners to the legal environment. The gathering of legal recourse in Shanghai International Dispute Resolution Center remarkably contributed to the prosperous development of the Qiantan area, which helps Shanghai in becoming a global lounge for the world.

     Ms. Liu Xiaohong, President of Shanghai University of Political Science and Law and member of the International Commercial Court Expert Committee of the Supreme People’s Court, delivered special remarks for the event. She reviewed her experience of hosting the Moot Shanghai competitions, and editing the Explanation of China (Shanghai) Pilot Free Trade Zone Arbitration Rules, and talked about the undertaking of legal professionals. She pointed out that, as an alternative dispute resolution method, arbitration has a bright future at home and abroad. To enhance the soft power of an international arbitration hub, we have to improve in ways of economic and city development, beneficial policies, business environment, legal guarantees, personnel training and so on.

    The first session of the event focused on the keywords of young people and international arbitration in Shanghai, during which the opening of the 11th Moot Shanghai competition was officially announced. The executive chief of the competition, Ms. He Weirong, introduced the preparation of this year’s competition. Moot Shanghai is the only Chinese moot competition which includes the participation of oversea participants. This year, over 400 competitors out of 60 teams from over 22 nations participated Moot Shanghai, which has broken the record of any former competition.

  This year, the Moot Shanghai Competition is organized by East China University of Political Science and Law and Shanghai University of Political Science and Law, and co-hosted by SHIAC and ICC Shanghai. Representatives from the organizers and representative from the Shanghai Bar Association, who is one of the supporters for the competition, delivered speeches on the opening ceremony.


   Ms. Wu Qiaofang, Head of International Exchange Office of East China University of Political Science and Law, mentioned that, the further opening-up of China need solid foundation of legal guarantees. As a way of dispute resolution method which conforms with international practices, arbitration has an urgent demand for high-level legal personnel, so that we shall pay more attention to the cultivation for those people to promote the development of arbitration of China.

   Mr. Xu Guojian, the specially-invited dean of the international law school of Shanghai University of Political Science and Law, mentioned that, talent cultivation should be put forward in both theoretical and practical ways. As a globally well-known moot competition, Moot Shanghai has made great contribution to providing international legal competition platform, promoting rule of law and accelerating legal communications.

 

   Ms. Wang Weijun, Deputy Secretary-General of SHIAC, mentioned that, SHIAC has always been paying attention to arbitration personnel cultivation and providing platforms for young students and lawyers to practice international arbitration. By means of arbitrator recommendation, providing venues for semi-final and final competitions, hosting SHIAC’s open day event and related forums, SHIAC has given various kinds of support for Moot Shanghai. SHIAC will continue to stick to the initial purpose of promoting arbitration, and provide the soil of legal personnel cultivation.

   Mr. Huang Ningning, Chairman of Foreign Affairs Committee of Shanghai Bar Association, talked about arbitration training, especially the training programs of bar associations and arbitration institutions. He also encouraged young lawyers to broaden horizons and enhance professional and practical skills.

    After the speeches, Mr. Fan Mingchao, Chief Representative of ICC Shanghai and Director of the ICC Arbitration & ADR, North Asia, announced the annual key visual of this year’s Moot Shanghai.

    Later on, the second session of the event went into the conversation between SHAIC and ICC. At first, Mr. Ma Yi, Vice Chairman & Secretary-General of SHIAC congratulated Ms. Claudia T. Salomon for her appointment as the next president of ICC International Court of Arbitration and welcomed ICC Shanghai to settle in Shanghai International Dispute Resolution Center.


    Mr. Peter Corne, Arbitrator of SHIAC and managing partner of Dorsey & Whitney LLP Shanghai Office, connected with Ms. Claudian T. Salomon via online video to talk on topics of the diversity and inclusiveness in international arbitration.


   Mr. Yu Weifeng, Chairman of Shanghai Arbitration Association made comments on the dialogue between Mr. Peter Corne and Ms. Claudia T. Salomon. He said that the diversity and inclusiveness are equally important for international arbitration. The legal community has the mission in promoting Shanghai into an international arbitration hub in the Asia-Pacific area, while at the same time, welcomes more communication and interactions with other international arbitration institutions.

At the end of the event, Mr. Fan Mingchao, Chief Representative of ICC Shanghai and Director of the ICC Arbitration & ADR, North Asia, delivered the closing remarks.


   In recent years, along with the rapid growth of economy and international dispute resolution legal service market in the Asia-Pacific area, great opportunity has been brought to Shanghai in building an international dispute resolution hub. In 2015, the State Council released the Plan for Further Deepening the Reform and Opening-up of China (Shanghai) Pilot Free Trade Zone, in which the goal and requirement for Shanghai to accelerate the building of an globally oriented international arbitration hub in the Asia-Pacific area was set forward. Later on, following the settlement of the Shanghai offices of Hong Kong International Arbitration Center, ICC International Court of Arbitration, Singapore International Arbitration Center, Korean Commercial Arbitration Board, WIPO Arbitration & Mediation Shanghai Center and CAS Shanghai Alternative Hearing Centre, a new structure was formed by these international institutions above and the local institutions, which are SHIAC and Shanghai Arbitration Commission. Shanghai has become the city with the biggest number of arbitration institutions and the most arbitration resource in China. In April 2018, the Shanghai International Dispute Resolution Center, which was initiated by SHIAC, was approved by the administrative department, and started to invite well-known international arbitration institutions, dispute resolution bodies and arbitration industry associations to move in, in order to promote the building of an international dispute resolution hub in Shanghai. In 2019, it were also mentioned in the Implementation Opinions for improvement of arbitration system, enhancing public credibility of arbitration, accelerating the building of a globally oriented international arbitration hub in the Asia-Pacific area and the Opinions for supporting Pudong district to start again in opening up and to fulfill high-quality development in new era, that Shanghai is aiming to be built as an international hub for international dispute resolution.

    SHIAC is going to persist its way of international and professional development, to further improve the gathering platform of Shanghai International Dispute Resolution, promote the communication and interaction between different dispute resolution culture, explore more diversified corporation, in order to make Shanghai a global lounge for legal practitioners, enhance the soft power of Shanghai in building an international arbitration hub, upgrade the brand of Shanghai arbitration, and maximize the positive role of arbitration in improving investment and business environment, facilitating the opening up and expanding the international influence of Shanghai.
