SHIAC Vice Chairman Li Zhigang attended the 3rd BRICS Legal Forum

From September 10th to 12th, 2016, the 3rd BRICS Legal Forum was successfully hosted by the Bar Association of India in New Delhi, India. The attendees included over 200 legal experts and embassy representatives from Brazil, China, India, Russia and South Africa. Mr. Li Zhigang, Vice Chairman of SHIAC led a delegation to the forum.

With the thesis of Developing Legal Frameworks for Building Responsive, Inclusive & Collective Solutions, the participants conducted effective discussions on hot issues of Financial and Legal Cooperation in BRICS: Key Issues and Thrust Areas, Emerging Frameworks in International Commercial and Civil Law: Need for a Cohesive BRICS Strategy and Cooperation Mechanism, and International Arbitration and Dispute Resolution: Making BRICS Institutions Forum of Choice for BRICS and Emerging World.

At the plenary session, Mr. Chen Jiping, Executive Vice-President of the China Law Society, Dr. Lalit Bhasin, President of the Society of Indian Law Firms, Mr. Venugopal, Co-Chair of the Bar Association of India, Mr. Mukul Rohatgi, Attorney General for India, Mr. Shankardass, President of the Bar Association of India, Mr. Alexey A. Klishin, Chairman of Legal Commission of Modern Integration Processes of the Association of Lawyers of Russia, Mr. Luiz Tracisio Teixeira Ferreira, President of Coordination of BRICS, and Mr. Mvuso Notyes, Co-Chairperson of the Law Society of South Africa all delivered their key note speeches.

In Mr. Chen Jiping’s speech, he noted that the BRICS had become a powerful force in promoting the world multi-polarization, building new international political and economic order and maintaining the world’s peace and development. The BRICS should enhance communication, gather consensus and make concerted efforts to be the continuous engine for the global economy, improve our discourse and decision-making power in international affairs, promote the legalization and democratization of international relations, and construct efficient, inclusive, open and all-win cooperation mechanism. Mr. Chen proposed to gather the BRICS cooperation consensus, consolidate the BRICS cooperation basis, protect vital measures under the BRICS cooperation mechanism, and prevent the risks and solve the disputes during cooperation. The field of law in China had the will to cooperate tightly with the counterparts in other BRICS countries to form a community of law and destiny, and infuse more legal positive energy and new power to the BRICS cooperation.

Mr. Li Zhigang delivered a speech with the topic of Prospect of cooperation in arbitration among the BRICS: From the perspective of the BRICS Dispute Resolution Center Shanghai. In the speech, Mr. Li noted that a suitable dispute resolution mechanism was demanded for the joint partnership and development among the BRICS. Rather than the rigid judicial sovereignty, ADRs like arbitration and mediation had become the optimal dispute resolution approaches in international economic interactions for their outstanding advantages. Arbitration’s advantages of enforceability, jurisdiction and convergence of procedures made it propitious for the BRICS cooperation on dispute resolution. Under the guidance of the China Law Society, SHIAC established the BRICS Dispute Resolution Center Shanghai on the 2nd BRICS Legal Forum, and the Experts Committee constituted by legal experts from the BRICS. As the first founded platform in the BRICS, the Center Shanghai had conducted beneficial exploration in regional arbitration cooperation and resources sharing. Mr. Li proposed to establish arbitration centers in every BRICS countries, and recruit persons who are familiar with the BRICS commercial practice and relate laws as arbitrators, so that the professionalism of the BRICS dispute resolution, the cooperation and resource sharing of regional arbitration can be achieved.

On the forum, the BRICS Dispute Resolution Center New Delhi was announced to be established and inaugurated. This Center New Delhi was the second BRICS dispute resolution center after the Center Shanghai.
