“2019 The 10th International Aviation Law Moot Court Competition” National Round successfully held in China

The 10th International Aviation Law Moot Court Competition national round in China was held in Shanghai International Aviation Arbitration Court during February 22th -24th 2019. It was hosted by China Law Society Aviation Law Research Association and organized by Shanghai International Aviation Arbitration Court. More than 30 players of five teams from East China University of Political Science & Law, Nanjing University of Aeronautics & Astronautics, Wuhan University, China Civil Aviation University, China University of Political Science & Law participated in this competition.


Dr. Xie Xingquan, Deputy General Counsel of International Air Transport Association; Mr. Ding Chunyu, Secretary of CPC Committee of International Cooperation Service Center, Civil Aviation Administration China; Dr. Lijuan Ke, Professor of Law at Soochow University; Mr. Liu He, Deputy Director of Legal Affairs Division of Civil Aviation Administration China; Ms. Chen Shiqi, Deputy General Manager of International Affairs Office, Legal Compliance Department of China Eastern Airlines; and Ms. Chen Yu, Deputy Manager of Foreign Affairs Office, Legal Standards Department in China Southern Airlines Group Co., Ltd., served as judges.


The Moot Court case mainly involved the explanation and application for the relevant rules under International Civil Aviation Convention 1944 (Chicago Convention) and Convention for the Suppression of Unlawful ACTS relating to International Civil Aviation 2010 (Beijing Convention), which requires the participating teams to analyze and demonstrate the state's obligation to punish ACTS endangering the safety of international civil aviation, the obligation to extradite or prosecute, the authority to establish air restricted zones, the explanation and application for air transport service agreements and international legal liabilities etc. As the language is English the participating teams went through a fierce round-robin match lasting two days.


The award ceremony was held at Shanghai International Aviation Arbitration Court on February 24th. Ms. Wang Weijun, Deputy Secretary-General of Shanghai International Economic and Trade Arbitration Commission (Shanghai International Arbitration Center), presided over the award ceremony.


The judges commented on the teams' performance from the aspects of language ability, legal skills, debate skills and on-the-spot response, they also suggested that the participants should enhance their self-confidence to deal with all kinds of questions raised by the judges calmly. Meanwhile, they have to pay attention to the expression logic, professional posture, eyes, body language and other details and try to avoid the words mistakes in the pleadings, and pay attention to the rigor in the expression. After scoring and evaluation collectively by the judge, Wuhan University won the championship, East China University of Political Science and Law won the second prize, China University of Political Science and Law won the third place, and University of Civil Aviation China and Nanjing University of Aeronautics and Astronautics won the winner award.


Mr. Guo Junxiu, President of Aviation Law Research Association of China Law Society, General Counsel of China Eastern Airlines Group Co., Ltd.; Mr. Ma Yi, Vice Chairman and Secretary General of Shanghai International Economic and Trade Arbitration Commission (Shanghai International Arbitration Center); Mr. Xie Xingquan, Deputy General Counsel of International Air Transport Association; Mr. Ding Chunyu, Deputy Director and Secretary General of Secretary of the Party committee, International Cooperation Service Center of Civil Aviation Administration of China, awarded trophies and certificates to the participating teams.


Wuhan University and East China University of Political Science and Law won the Best Written Pleadings award. The Civil Aviation University of China and Wuhan University won the Certificate of Excellence. Mr. Zheng Pai, the judge of the 10th "Leiden-Selin" International Aviation Law Moot Court Competition and representative of China regional trial, presented the certificate of award for the Best Written Pleadings team. Ms. Chen Shiqi, Deputy General Manager, International Affairs Office of legal compliance department, China Eastern Airlines Co., Ltd. presented a certificate of  award to the Outstanding Written Pleadings teams.


Mr. Qiao Yanjie from East China University of Political Science and Law and Ms. Guan Qianli from Wuhan University got the award of the best debaters. Ms. Li Yirui from China University of Political Science & Law and Ms. Tan Yonghui from East China University of Political Science & Law got the award of the excellent debaters. Mr. Liu He, Deputy Director of Political, Legal & Judicial Planning Division, Civil Aviation Administration China, presented the certificate of commendation to the best debater. Ms. Chen Yu, Deputy Manager of Foreign Affairs Office, Legal Standard Department of China Southern Airlines Group Co., Ltd. presented the certificate of merit for the excellent debater.


Professor Zhu Ziqin from China University of Political Science & Law won the Best Organization Award. Ms. Nie Jingjing from Civil Aviation University of China and Mr. Nie Mingyan from Nanjing University of Aeronautics & Astronautics won the Outstanding Organization Award. Mr. Zhang Weimin, Vice President of Aviation Law Research Association of China Law Society presented the award to Pro. Zhu Ziqin. Dr. Lijuan Ko, Professor of Law at Soochow University presented award to Ms. Nie Jingjing and Mr. Nie Mingyan.


Mr. Ma Yi made a closing speech on behalf of the organizers. He expressed his appreciation to all the judges for their contributions to International Debate and Moot Court Competition, which is a valuable opportunity for law students to combine theory with practice and exercise their foreign language skill. He addressed the students with "compassion, persistence, and confidence", and hoped that everyone will uphold the rigorous legal feelings, continue to improve the research ability of international aviation law, actively devote yourself to the aerospace law work in the future, adhere to the original intention for the aviation law of the predecessors, Not belittling yourself or being arrogant, make outstanding achievements and have a bright future.


The top three winners in this competition will qualify to represent China for the 10th International Aviation Law Moot Court Competition in India in early April 2019. “Leiden–Sarin” International Air Law Moot Court Competition is the most influential competition in the field of international air law and the only world-class moot court competition in air law. It was proposed to be established by the International Civil Aviation Organization (ICAO) and is founded by some front-line institutions engaged in teaching and research of international air law, such as the International Research Center for Aviation Law and Space Law (IIASL) of Universiteit Leiden, and the India Sarin Memorial Legal Aid Fund.


The competition is held annually. It has been successfully held in Delhi (India); Dubai (United Arab Emirates); Istanbul (Turkey); ABU Dhabi (United Arab Emirates); Bucharest (Romania); Beijing (China); (Jakarta) Indonesia; Valletta (Malta); and Seoul (South Korea).


The International Aviation Law Moot Court Competition has attracted the students from many well-known universities in China, Netherlands, France, Germany, Greece, Turkey, Cyprus, Russia, Poland, Ukraine, Australia, New Zealand, India, Singapore, Indonesia, South Korea, Sri Lanka, UAE, Ecuador, United States and Canada etc.to compete with each other, which provides the opportunities and stage for them to gain experiences and development in the field of international law and aviation law.
